Entering my right of way onto someone else’s title deeds

Hi all, <br> <br> I have a right of way articulate in my title deeds over an access lane to the rear of my property. It’s included in both the written deed and the title plan. It’s not my main property access but still useful. <br> <br> it is not shown on the title for the land over which I have right of way, and now a developer is talking about building over it. Can I request an amendment/update to the other deeds to include this right of way? <br> <br> there are a couple of other properties that have the same right of way as me. <br> <br> thanks in advance.

Hi Duncan - you can apply to register the easement on the servient land/title using form AP1 along with supporting evidence as appropriate <br> <a href="https://www.gov.uk/government/publications/easements">Easements (PG62) - GOV.UK</a> <br> I would however recommend seeking legal advice first to confirm the legal position for you, and others, re the right to consider what's need to put the owner of the servient land on notice and/or to register the right on their title<br> Land registration is complex, designed to protect legal and financial interests in property.
