We were in the process of exchanging but was told a restriction charge was in place.<br> <br> <br> The sellers solicitor has confirmed the seller's lender is the process of removing the charge from the property, however this will take up to 12 working days.<br> <br> Adam can you please confirm an application has been put forward and if it has been expedite to speed up the process.<br> <br> Much appreciated 🙏 <br> <br> Kind regards <br> Jay

Jay - the process for removing the charge starts after exchange and on completion of the sale/purchase. The seller's conveyancer will undertake to remove (discharge) the seller's charge and their lender will then submit the forms etc to achieve that<br> There is no application as yet to remove their legal charge although I would not expect there to be one as yet.<br> Do speak to your conveyancer to confirm/clarify the above and what the hold up is<br> GM471481<br>

This appears confusing, the sellers solicitor send mine solicitor the attached email.

Jay - then your Q is for the conveyancer involved as to how the charge is being removed prior to exchange/completion.<br> It maybe that they are able to remove it without your purchase monies and as such have agreed to do that first. <br> Not the usual sale/purchase process for most but only the conveyancer, lender or seller can explain that for you <br> Key follow up Q for them is whether the lender will remove the charge electronically or not. IF not then they need to submit their application and then request expedition separately - if they don't the processing won't start for a while.<br> GM471481

Hi Adam, the seller have advised their lender will removed this electronically, please how long does this take if already submitted.

Thanks Adam was informed it was put through yesterday and hopefully we should get a response and an update today.  But will like you to check if there is truely an application 🤔. I feel like i keep going back and forth

Jay - still nothing. Once an application is submitted they should be able to confirm the title number AND our (ABR) reference. Ask them for both and that way you know they've applied<br> GM471481

I have been given a reference number in regards to the application <br> J971FBV and my solicitor confirmed the other seller side has submitted an application and its been expedited.<br> Not sure but can you confirm if an application has been submitted and expedited.<br> <br> Kind regards<br> Jay

Jay - excellent. That's an application submitted on 29th September to discharge (remove) a legal charge (mortgage) from the title<br> Now it's been submitted check with your own conveyancer to confirm that you can continue with the sale/purchase<br> If you can't and they say it needs to be processed first then a request to expedite it should be submitted - <a href="https://www.gov.uk/guidance/request-an-expedite">Request an expedite - GOV.UK</a><br> GM471481

Jay - it has been expedited now. Please note that as the lender has submitted a paper application (they probably had no choice) then wider checks will be required involving our contacting them in writing to confirm removal. So there will be a delay in completing the process (15 business days unless they respond sooner) once those wider checks have started - processing should start in the next few days due to expedition<br> GM471481

Good news Adam and I can't thank you enough. I am a bit confused here as am a first time buyers, is this not suppose to be straight forward after since the lenders themselves are applying to get the charge removed...why should you write them in returned to ask for confirmation before finalising the process and which response are we talking about about they have personally put the application forward to discharge. Sorry I stand to be corrected as am a bit naive and confused buyer.

Oh just had a call from the estate agent saying the charge has been removed per the information she just received from the seller solicitors. Please confirm

Jay - completed and register updated at 9am this morning<br> It can be confusing but all depends on the details involved. I was just being cautious with my previous post so you did not simply assume expedition meant all ok and done immediately. My caution was however unfounded in your case <br> GM471481
