Hi,

We have ran into an issue on the sale of our shared ownership property. Please bear with me and my long post while I try to explain what has happened as I’m struggling to get my head around it myself.

We are selling our 50% share and the housing associations 50% share to the same buyer who will then have the deeds transferred over into their name and own 100% of the house and the freehold. So we needed the current restrictions regarding our leasehold removed.

When my solicitor has checked this they have found the following:
there are two restrictions which refer to our shared ownership lease (registered under title number ND214279)
The restrictions on your register refer to title number ND110570 (land owned by Gleeson). This is incorrect.
They should refer to ND214154 (the freehold which the housing association owns, under which our leasehold interest is registered under NDND214279).

The housing associations solicitors have been in touch with land registry and filled in all of the relevant paper work to have the issue resolved and I have heard from my solicitor that they have requested this be expedited (we have been waiting for this to be resolved since July and I am currently 35 weeks pregnant)

We haven’t had an update from the housing associations solicitor as of yet and I’m getting pretty desperate for answers on how long this is going to potentially take (E.g do I need to prepare for baby coming in this house and not the new one)

Please could you let me know if the request to expedite has been approved and if so roughly how long this kind of mistake will take to be rectified?

Thank you in advance!

Hi Kaity - the solicitors submitted an application on 17th September and requested it be expedited. Due to the nature of the application it needs to be considered by one of our lawyers and it is currently waiting to be so.
I can't be definitive re timescales from here but will escalate it with the support team to ask for an update. I'll post again once I have one.
ND214279

Hi Kaity - unfortunately the wrong application has been submitted so the casework team have gone back to the solicitor to explain why and how they can correct matters. They'll need to submit the correct application to enable matters to proceed
|You may wish to confirm with them and then come back to me once you know that they have submitted the correct forms and information and we can try again and expeditiously
ND214279

Thank you for the update. Not the news we were looking for! I will chase this with our solicitors right away and see if they can get in touch with the housing associations solicitors to submit the correct document. Thank you for your help so far I will be in touch when I hear from them.
