I am currently in the process of buying out my partner from our flat. The remortgage is approved and I am in the stage of sorting it all with the conveyancers. However I am paused because I have received the below, please advise what this application is and how I get around this! My neighbours bought their flat in January or february and we bought end of March, and my purchase is visible on the land registry site so not sure the issue. My neighbours purchase is not visible so maybe that’s the issue? It’s a share of freehold flat, so has a freehold title and leasehold title, but there are only the two flats included on the titles. Please advise ASAP!! &#160;Property address: 93b Chobham Road London&#160; <p><br> Pending application at land registry:</p> <p>We have now carried out our investigation of title and note that there is an application pending at the Land Registry against your property title. This means that the land registry records for your property are currently 'locked' because another solicitor has applied to make changes to it. Please note we are unable to progress to completion of your remortgage until this application has either been completed or removed. This is because your new lender requires us to check the property title on their behalf to ensure that it is suitable to be used as security for their mortgage. We are unable to make these checks whilst there is a pending change to the details and/or whilst the title is locked against registration of any further changes as this means we cannot apply to register the remortgage. We will also require you to send us an updated copy of the Register from the Land Registry when the application is completed or removed.</p>

Rachel - interesting and something I would expect your conveyancer to be able to explain to you.<br> The property is registered freehold along with two leaseholds, one for each flat<br> The freehold title&#160;EGL33634 has a pending application to transfer the title into your name and others and that's dated from March.<br> <strong>The leasehold title for 93B was transferred into your name in March and the register updated at the end of August</strong><br> The other leasehold for 93A was transferred back in December but their application was lodged in April and as yet has not been registered<br> I imagine the fact that the two leaseholds were being sold/transferred around the same time complicated matters re the transfer of the freehold&#160;<br> I don't know when your conveyancer shared the above comment with you but if it was before the 28th August then they should re-check the leasehold title as that confirms your joint ownership.<br> If for some reason the application to update the freehold register is an issue then they/you can request expedition to get it moving sooner -&#160;<a href="https://www.gov.uk/guidance/request-an-expedite">Request an expedite - GOV.UK</a>&#160;EGL33634 -&#160;G038KVT<br> Please note that if you are buying out your partner, so that the two of you are transferring the leasehold into just your own name, then the two of you + the other flat owners will need to transfer the freehold title into just your name + the other flat owners. Worth checking with the conveyancer to confirm as I suspect they are acting primarily for your lender and may not have yet considered the freehold title and wider joint ownership

<p>Hi Adam,&#160;</p> <p>okay thank you It was sent on the 22nd August so I will ask them to check again!&#160;<br> &#160;</p> <p>When applying for my remortgage my mortgage advisor (from the bank the mortgage is with) said I could use their in house solicitor for both remortgage as well as transfer of equity. So this should cover everything correct? The Company they use it Integrar and they don’t seem to have a way of really contacting them, just this online portal, which is where the update about the land registry issue was.</p> <p>do you think this is okay, will they be able to sort the transfer for both freehold and leasehold titles?</p>

Hi Rachel - yes, ask them to check again<br> Yes - they should cover everything but in my experience the 'shared' freehold can be missed and if it is then you and the other Flat owners may have a problem later as your partner will still be one of the joint legal owners of the freehold - I assume that's not what's wanted<br> Just flag the fact that the leaseholders for both 93A and 93B together own the freehold title&nbsp;EGL33634. As (if) you are removing your partner completely then ask them to ensure that a transfer of the freehold is also in their thoughts/plans with regards next steps

I need to attach a document proving it’s complete&#160;but not sure where I get that from!</p>

Hi Rachel - all a Q of what type of copy they want. You can search online and download a copy of the register and that reads as if it should be sufficient -&#160;<a href="https://www.gov.uk/search-property-information-land-registry">Search for land and property information - GOV.UK</a>&#160;<br> If they require an 'official copy' then you can apply by post for that - see the same guidance but read further on re applying by post using form OC1

<p>Thanks Adam! All super helpful. I contacted my conveyancer and they said online copies would suffice but that I needed both the leasehold and freehold titles. So I have requested the freehold be expedited and had that approved so It should be complete within 10 days. My original solicitor actually sent me a copy of the leasehold title so that’s saved me £7 at least! Are you able to let me know when the freehold is complete so I can request this from my solicitor also?</p>

Rachel - it was expedited today. I should stress that expedition does not guarantee it is completed within 10 days as applications can be submitted poorly and more is required and/or wider checks can be needed<br> In this case the former is true and the casework team have already contacted the conveyancer to advise them as to what's wrong and what's needed to enable them to complete the registration<br> You'll need to speak to the conveyancer to confirm&#160;<br> EGL33634&#160;
