my siblings and I were left a parcel of land with a title number , there are 4 of us in total would it be possible to split this land into 2 pieces with 2 names on each piece and have a different title number

V Walsh - yes if the legal owner transfers a part as appropriate. Such a transfer of part then splits the title and the new part gets it's own title number. They can then transfer the remainder of the whole to the other new owners.


To transfer registered land or property you will need to send us:

Application form in Form AP1.This guidance will help you complete this form correctly. There is also a "Youtube" video which may assist you.

Form TR1 should be used where the whole of the land or property is being transferred (including shares in the property). Guidance is available to help you complete the Form TR1 correctly there is also a "YouTube" video on completion of TR1 which may assist you. If you are transferring a physical part of the land (such as a section of garden) you will need a TP1.

Evidence of Identity is usually required for all parties to the transaction unless they are represented by a conveyancer. See Practice guide 67: evidence of identity for more information and the options available to you.

Fees to register the transfer deed. Our fee order contains guidance on all our fees which are based on the value of the property or the share being transferred. To work out what you need to pay for your application, you can use our fee calculator tool available on our fee order page. Cheques or postal orders are payable to HM Land Registry.

Even if no money is changing hands, you should contact HMRC and check your responsibilities in respect of Stamp Duty Land Tax (England) or Land Transaction Tax (Wales). HMRC will provide you with a "Land Transaction Return Certificate" or submission receipt which should be sent to us with your application.

We have an existing registered property with a parcel of land . We have recently converted the barn and and are living in this . We want to be able to split the property so that both houses have their own portion of land registered individually . As we want to sell the original property and some of the land 
How do we do this?

Elizabeth - this is covered in a number of other forum threads - see Sub-division  · HM Land Registry

Please note that the actual sub-division occurs naturally when titles are transferred as parts and the buyers then register the split and their purchase. As such it is rare to apply to sub divide by transferring in parts as it's rarely necessary.

Not sure if this is the correct place, but can someone please give me advice. My mum has a commercial shop and a flat upstairs, how and what does she need to do the separate the two? Many thanks

Good morning, 
I am an executor for an estate and require to split a parcel of land into two separate titles.
At present access in on the original property.  Do I require a complete new  survey to show the joint access, or can the present land registry certificate plan be amended.?

Good Morning Susan - why do you need to split the title at this stage?
If you are going to sell/transfer part of the title; create a new access; and grant/reserve a right (easement) to use that access then all of that would be part of any actual sale/transfer. 
You may want a surveyor to prepare a suitable plan for the transfer or you can use the existing title plan and add the required details. But you don't split the title first.

Land registration is complex, designed to protect legal and financial interests in property. There can be significant consequences for any error. Please consider seeking legal representation.
