Hi, 

Which form do you use to remove an equitable charge? The notice on the land registry is as follows: 

Equitable charge created by an interim charging
order of the County Court at Walsall dated 3 July
2015 in favour of BMW Financial Services (GB)
Limited (Court Reference 0BM74231).

How come on the form it is asking about leases and rent charges?

Sunny - form CN1 is a generic form used to apply to cancel a variety of interests 

See PG 19 section 2.7.1

Thank you. I believe you are in receipt of one of our applications

Our client has another equitable charge on his property from BMW finance. However, they can't find any record of his details or agreements. Their solicitors are struggling as well. Can we send the email correspondences as evidence that this charge maybe applied incorrectly?

Hello, 

Can you confirm you recieved a CN1 form signed by our client? The tracking is showing it was delivered on the 22nd January 2025 and it was for the removal of the charging order relating to Birmingham City Council. Title number is WM925732

Hello Sunny - we have received a form CN1 on 22nd Jan although the applicant has not completed the form with his details inc name, address and phone number/email 
I would suggest that he uses our contact form to submit the additional details 
T508LST (our case reference) and WM925732

hi apologies if this is not the correct place for this.

But, My husband and another party has had a restriction on his land registry from over 10 years ago, we have tried contacting court in question and give them the court reference which is stated on land registry to which their reply was there is nothing on our system also contacted solicitor who represented husband and other party ( other party dealt with this as it arouse) we however where unable to and then slipped our minds only came apparent again when trying to re mortgage property. we do not have any information of amount payable how or who we are to pay it to, where to move forward with this feels like we at a stand

 any help possible please or a point in the right direction would be much appreciated

Hi Jodie - we can usually only supply the registered information which would confirm the date of the charge and the creditor for example. We should have copies of the original application and supporting evidence and you can apply by post for copies if you wish to - Get information about property and land: Get a copy of the deeds - GOV.UK
As for applying to cancel a restriction then you would do that using a form RX3 plus supporting evidence to show why it should be cancelled - Notices, restrictions and protection of third-party interests (PG19) - GOV.UK
It's probably legal advice/help you really need here but happy to take a look at the registered information if you share the title number
