If we discover an error or need to update an ADV1 / SOT after it has been submitted in an adverse possession case, is it possible to do so or would we need to withdraw and start again? The case involves contact with the registered owner post signing - but pre submission owing to a delay in the submission process.

Paula - if the application is pending and you need to amend/replace a submitted form you can do so without withdrawing your application

It is pending. Thank you. Do you know if subsequent contact with the registered landowner invalidates the application? No settlement was offered or reached by either party.

Paula - in general terms it's unlikely as the claim is based on the facts provided at any given time. If your statement changes those facts, and includes any contact with the landowner that then implies consent to use/occupation of the land, then you may have an issue. All depends on what you mean by discovering an error as posted and what impact that has on the statement of the facts in support of the claim. Any consideration of such matters, where revealed, would only be considered as part of the actual application. I can't comment definitively here but worth bearing in mind that even if no mention made in claim the registered owner may well refer/raise in any responses to their notification of the application to register
