As above, we have a matter where a residential lease is extended, there is deed of substituted security (DoSS) to transfer mortgage but as this is not a main stream lender (no MD ref), do we need to put RX1 to cover the same restrictions as they were on the old lease or will the DoSS replicate these on the new leasehold title.

Amit - if it's unapproved you'll also need form RX1 for a new restriction to be added to the newly created and charged title

When you mean unapproved - what do you mean here? The restrictions are lender restriction on title on the original charge registered on the original lease - registration was previously done by the lenders solicitors and not us.

Amit - unapproved as in no MD Ref. So based on what you have stated you'll also need a form RX1 to apply for a restriction on the new title after the old one is surrendered

MD Refs are only provided on approved forms of legal charge
