At the time of Inclosure act in 1788 an area of common land was given to the local Lord of the Manor in exchange for an equivalent area of land to be used as a sand pit for the repair of local highways. As the Lord had gained a superior quality of farm land he had to pay 15 shillings each year into the local poor fund. The sandpit was in use into the early 1900’s and since then it has developed into a very natural Oakwood. It was not being looked after so I requested the registration details from HM land registry to make sure that it was in public ownership but found that it has been included with the local Estates title deeds. I looked into the relevant Inclosure Act at WYAS and the document confirms it was given for the repair of the highways and for private use of residents “for ever”.
I think this has been registered by the Estate in error. Can it be allowed?

James - something to seek legal advice on to understand how the law works re such matters. Not just with regards how registered but also how the historical information impacts/was dealt with
