My freehold is subject to a lease that I have found out is bona vacantia with the Duchy of Lancaster. The BV lease covers my whole development and I am the only freeholder. Is there any precedent of a freehold being removed from a lease in these circumstances. I asked the Duchy’s solicitor and they can’t advise me. I am trying to sell and this is a deal breaker for the buyer.

Emily - we wouldn't be able to advise if there was a precedent scenario and it's very much your conveyancer/legal rep you need to rely on here with regards either removal or options to placate the buyer, for example an indemnity policy?
