Is a certified copy of probate required when submitting Form ST5 to the Land Registry?

Vian - if you need to prove/confirm that someone has died then a certified copy of a probate can be used to provide that. Form ST5 is a statement of truth that can be used to accompany another application form. It wouldn't generally be relied upon to prove someone's death for example

I understand that, but is it necessary to provide a copy of probate as well as death certificate specifically for Form ST5 in addition to the other forms required to transfer title to the surviving tenant in common or is just the death certificate sufficient for all the forms including ST5?

Vian - can you explain precisely what it is you are applying for please? I ask as I am guessing that you have two or more registered joint owners and a form A restriction. One of the joint owners has died and you are trying to update the register as appropriate. If those assumptions are correct you need forms RX3, ST5 and a certified copy of either the death certificate or probate. There is no transfer (form TR1) involved
