Dear Adam,

Our application submitted last April is now being processed under ref Y917NJT which is good news.
It is an application to register a right of way by prescription.

Could you please let me know if HMLR will copy us into correspondence notifying the owner of the burdened land about the application ? 
It would be extremely helpful to know when their 21 day reply period expires.

Or if we will not be copied in, can you let us know ?

Dear Bettina - the application is still being processed as we needed more from the applicant, which they have now replied to.
If the application progresses to the next stage then notifications are generally issued to any affected land/property owners as appropriate. But as stated that's not been decided as yet

Another couple of months have passed and we still have not heard anything if our application is progressing.
Could you please check it for us again, it is more than a year since we applied and it is important for us to get this sorted.

Dear Adam,

we received the letter and dealt with the reply promptly, it was sent to Mr Rutter on May. 13th but now we are back to this prolonged silence, 6 weeks have passed.

The letter asked for an amendment on the application form, which very surprisingly was not mentioned in the request for further information back in February.

Can you please check again what is happening please.

It is rather frustrating that it takes so long between correspondence.

I'm sorry that the process is proving to be frustrating. Unfortunately such applications are complex and do require referral to specific senior officers for consideration/approval and that can lengthen wait times as a result
I'll share an update once I have something concrete to share

almost another month passed and no news.

it is getting very frustrating and affects our ability to make decisions about our future. We expected it to take up to a year but we are now nearly 16 months since submitting our application and it hasn’t really progressed beyond ‘being processed’. 

Could you kindly check for me again please

Dear Bettina - I've expressed the urgency again on the referral and they expect it to progress further today. 
If the response from the conveyancer is sufficient it should then move to it's final stage, namely wider checks with those who own the land over which the right is being claimed

Dear Adam

The deadline for objections from the subservient landowner to our application was the 21st August.

I was told by the caseworker, who called me at the end of July, that we will be notified if an objection has been received. She did not say however when we would be notified, upon receipt of an objection or after the deadline has passed ? 

So far we have not heard anything and given the lengthy process these things can take we wonder if you could check for us once again what the current status is ?

Dear Bettina - unfortunately we have received an objection to the registration although it is currently unclear as to whether the objection is groundless or not. The casework team have gone back to the objector for more information and asked them to respond by the 22nd September with more information as appropriate
As things stand matters cannot proceed until either they respond or that date is passed
