Hi Shahid - submitted end of June and based on current average timescales it's unlikely to be processed until Nov/Dec <br> When processing starts the casework team will contact you as appropriate<br> YK32178

Hi<br> I have remortgaged my house on 17.05.2005 my mortgage company was barclays bank,new remortgage company was Gmac then changed name to mortgage express.<br> Our solicitor forgot or by mistake did not transfer to the mortgage express the full title.<br> Barclays and mortgage express both them were proprietors until I have tried to sell the house.<br> When I was trying to sell my house on 2008 I have instructed my solicitor,he said he will let know with updates.<br> Weeks gone by everytime I ask about the progress ,he said he was waiting confirmation from my mortgage company mortgage express.<br> I have called mortgage express asking why they were not replying or blocking the sale of the house,they said they have nothing to do with anything blocking the sale.<br> They told me I can sell my house  to anybody, who buys the house they should have to pay them first clear the mortgage ,that is it.<br> I told my solicitor about whole conversation I had with my mortgage company.<br> He said he would look into some other things,he would call me in 2 weeks.<br> Two weeks later he called me saying that they paid money to barclays to discharge ownership from barclays to mortgage express (that should be done 3 years ago at the first place )  the next thing he said was  they  put a charge on my  property .<br> I asked him why you did not inform me about the whole progress putting a charge on my property,he said they do not demand any money from me,he did not disclosed the amount  of the charge ,I even do not know how much is the charge on the property even today.<br> <br> 2 years ago I filled the form on land registry ,they said they need confirmation from solicitor,they could remove the charge,but only problem is (1 of many) solicitor no longer exist.<br> Company was <br> <span style="color:inherit;font-family:inherit;font-size:36px;">BORNEOS LLP</span> <p id=company-number>Company number <strong>OC311771</strong></p> <table id=fhTable> <tbody> <tr> <td>08 Jan 2013</td> <td><strong> Final Gazette</strong> dissolved via compulsory strike-off</td> </tr> </tbody> </table> Because of company no longer exist I have no one to ask, to talk about my case.<br> What shall I do ,could anybody please help?<br> It has been dragging on long time.<br> I feel like I am trapped for 20 years by my solicitors incompetence,ignorance or simply their simple mistake ,oversight.<br> Sounds like you are my only hope.<br> Title number BM91079<br> <br> Kind regards<br> <br> Ali<br>

Ali - I am sorry to read of the issues you are facing <br> There is nothing that we can do directly until an application is submitted to remove (discharge) the legal charge(s) as appropriate. And that application will need to include supporting evidence as appropriate.<br> It is still very much legal advice/assistance you need here to understand how such matters work and how such legal charges can be discharged<br> The usual evidence of discharge is a form DS1 completed by the lender/creditor - <a href="https://www.gov.uk/government/publications/mortgage-cancellation-of-entries-for-lenders-ds1">Mortgage: cancellation of entries for lenders (DS1) - GOV.UK</a> <br> If the company has been dissolved then you will need to identify how it's assets have been or were dealt with and who is legally now able to discharge the legal charge - <a href="https://www.gov.uk/government/publications/corporate-insolvency">Corporate insolvency (PG35) - GOV.UK</a> <br> If your solicitor erred in some way then you should consider escalating the matter with the firm or also seeking legal advice as to your options and the best way forward <br> BM91079
