How do we remove 2 charges from property?

I need to remove 2 charges from my mother’s property. She has just gone into permanent residential care and we can’t apply for a deferred payment loan until the charges are removed. They are from 1993 and 1995. I thought they had been paid. I have no idea how to do this! The title number is BM55773. <br> <br> Many thanks,<br> Sophie Owen

Hello Sophie - I am assuming you are referring to the two Caution entries on the title. <br> <br> Please refer to section 5.5 of our <a href="https://www.gov.uk/government/publications/notices-restrictions-and-the-protection-of-third-party-interests-in-the-register">Practice Guide 19</a>.  It explains, depending on who is intending to apply, what forms need to be submitted.

Sophie - If you can get the person who has the benefit of the Caution to apply for it to be withdrawn then it would be easier and faster.  <br> <br> Otherwise we would need an application in <a href="https://www.gov.uk/government/publications/caution-against-dealings-cancellation-ccd">form CCD</a> together with evidence to support that the interest protected by the Caution has come to an end.  The application would have to be made by both the people named on the register as the legal owners.  If one or both are not able to do so then the person applying on their behalf, for example you, would have submit appropriate evidence to support why one or both are not party to the application. <br> <br> I hope this helps.

I sent the CCD form on Friday, on behalf of my mother. I am an attorney on the LPA for her as she has dementia. I have had an email today saying the application won’t be completed until February 2026. The reference for the form is S084KBV. Will both cautions definitely be removed from the property? I need to get a letter of undertaking from a solicitor for the local council, the house will eventually be used to pay for care home fees and we want to apply for a deferred payment loan.

<p>The cautions were on the property due to my father who died 11 years ago. I did send a certified copy of his death certificate. He was made bankrupt. Is there more evidence I should have sent with the form?</p>

Hello Sophie - The timescale quoted is because of the delays that we currently have.  Until the application is actually looked we cannot tell you if the cautions will be removed or if we need something more.  If we need any more evidence then we will write to you. <br> <br> If the delay in processing the application causes any difficulties or holds up some process, then you can <a href="https://www.gov.uk/guidance/request-an-expedite">request to expedite</a> the application.

Sophie - a correspondence from the council or the solicitor about your mother's care being dependent on the registration being completed would be acceptable.

Casework team processed it yesterday but need more from the applicant. A request has been issued by 1st class post with enclosures to be completed and returned as directed in the letter<br> S084KBV
