I am secretary of a group of churches and as some of these churches have primarily elderly members they are finding increasing difficulty in replacing Trustees. Many of these churches have Beneficial Trustees which is the group of Churches I represent. Can I apply to change ownership to the Beneficial Trustee or appoint the Beneficial Trustee as either the holding Trustee or custodian Trustee? In doing this will I need to seek the resignation of any of the existing Trustee/owners or will a simple request from the existing trustees to make the beneficial Trustee the new holding/custodian trustee suffice?

David - those are not Qs that we can answer and it is legal advice you require.
Our PG 24 explains the registration requirements re Private Trusts and change of trustees but how the trustees do it and more is not within our remit. We register the outcome of such decisions/actions

David - it all depends on how the trust is registered as the legal owner. The registers will confirm. The complexities/machinations and more of the actual trusts and it's trustees/beneficiaries may not always impact on the registered legal ownership as they relate more to the trust/beneficial interests and how those are referred to on the register can be quite limited - PG 24 explains
