Hi there,
I have a development loan on a project which is due for redemption in 48 hrs and have a new finance agreement in place waiting for registration to complete from land registry...this was expidite weeks ago and replies to enquiries have been submitted and still no update or registration...this needs to be registered tomorrow 1/10/24 or I face paying over £11k min in loan extension fees...my lawyer has chased regularly and I'm really concerned now about the impact this is going to have if it's not registered.

Hi Suzanne - so one of the applications (TT159937) was completed on the 27th September. 
There is a second title, TT86550, against which we have two pending applications. One re a Deed of Easement and the second re a transfer of part. It's the Transfer that's been expedited but that can't be completed until the Deed of Easement has been registered
Unsure which application 'needs to be registered' but will ask the casework team for an update/help as appropriate

Thank you for looking into this for me, I'm going to forward this to my lawyer now and see if the deed of easement has been applied for as well or if that is the part he is still waiting on...I have today for this to be registered and I'm getting nervous now.

Hi Adam,

My lawyer has come back to me saying that land registry have agreed to expedite both parts, and he has repeatedly chased, and highlighted if they need anything else from him but has had no response...any more updates you could provide would be gratefully received.

Hi Suzanne - I am still on the case but very reliant on the casework team here. Will update as soon as I have more information
The expedited application is a Transfer of Part as submitted by the conveyancer G H - it looks like we have requested more from them but as yet not received so IF that's the conveyancer you are contacting worth flagging with them?

Hi Suzanne - as I suspected we are still waiting on G H to supply more the expedited Transfer of part

But your focus may be on the prior application re the Deed of Easement. We need an extra form from that conveyancer and the casework team are contacting the conveyancer now. Hopefully they can respond asap

Conscious you are probably very much on the case yourself and will wait to see what you respond with also

Hi Adam,

Thank you very much for jumping straight onto this and getting a caseworker involved.
G H solicitors are the vendors / landowners law firm whom have dealt with the other sides legalities...and from past experience are not very responsive, my lawyer has chased them repeatedly but still no response to date.
I understand both my parts are registered now for which I'm very grateful! And without the other side's replies I'm stuck with today being my deadline.
I do hope LR have some luck in getting a response today and I'm very appreciative of your updates.

Hi Suzanne - I can see that the casework team did resolve one of the pending applications and contacted your conveyancer to explain what more is required.

G H have yet to respond and it maybe worth asking the purchaser/neighbour to 'chase' them also in an effort to elicit a response from them as their client?

Thank you once again!

I am wondering if there is a telephone number available to speak to someone regarding what can be done if the other party are unresponsive..GH are the conveyancers for the seller of whom I purchased from, subsequently some time after it became apparent that I had access issues and hence the need for deed of easement, it was a very difficult drawn out process due to the other party being difficult mostly and unresponsive and has cost me massively and now I find myself in a similar situation, contacting their client direct is not an option...GH have been chased and chased and still nothing.
I am now over my redemption due date and yet to await the consequences.

Hi Suzanne - there's nothing we can do re someone being unresponsive I'm afraid. The registration process provides for us to issue such requests and reminders as appropriate and that is already underway.
If the conveyancer is being unresponsive then you should raise a complaint with them although I would suggest that's perhaps better coming from their client 
We have no powers to force them to respond for example and the casework team would not be able to offer you any more assistance than what has been given on the forum and through my contact with them to date.
In an effort to help I will email the conveyancer separately to ask them to respond asap but they may not respond or react and there may also be other reasons for the delay in doing so and we would not be privy to those.
Your 'best' bet is to ask your own conveyancer to consider any professional peer pressure they might be able to add to the process although I suspect they have already done so on your behalf.

Dear Adam,
Thank you so much for your help previously on this matter, it's very much appreciated!
It turned out that GH just sat down for 2 months and made no headway on expediting his side at all until 2/10 which has now put my current loan 2 months overdue so a great cost to me in interest and legal fees of chasing him up.
The reason I have come back here is to ask if you could help out once again please? As far as I am aware the requisition letter from secretary of state was released 4 days ago so is it possible for LR to be looking out for it please and as soon as they have it can the registration be completed? Also is there anything else they are waiting on from GH because I literally have no faith in them being proactive in fact the opposite, and I cannot afford any more hold ups, I'm also having to liaise with 2 sets of lenders to keep them updated.
So any light you can she'd on this and any help at your end would be hugely appreciated!

Dear Suzanne - the application is the one with provisional title number TT169708 where we are awaiting a response from GH to our request dated 16th Sept. We haven't received the consent/certificate requested as yet but hopefully it is, as you state, on it's way
If it's received and found to be in order then hopefully matters can be completed quickly but it's impossible to be definitive at this stage - sorry

Thank you very much for that confirmation, it puts my mind at ease that this is the final piece everyone is waiting on...my current lender is very kindly keeping an eye on the LR for me so hopefully soon il receive confirmation that all is on title.

Good morning Adam,

I hope you are well.

My lawyer emailed late Friday afternoon saying that the long awaited requisition letter has been sent out finally, I just wondered if it was possible please for this to be kept an eye out for?  And as soon as it reaches LR could the registration take place? I am very very up against it at my end and it’s been extremely stressful, and any help your end to get this over the line would be hugely appreciated!

Thank you Adam...my new loan facility has been extended until 20th but past that I’m unclear, i would like to think that GH would get it over to yourselves today / tomorrow the latest, and anything that could speed up registration would mean a lot to me.
I will keep an eye on the title also.

I am sorry to bother you again, but my lawyer is asking have you received the requisition yet from GH? It should of been sent yesterday and I’m on very limited time to complete by Thursday / Friday as the legal swill take a couple of days...I am hoping very much that LR have it.
