<p>Good morning,<br> <br> I purchased a leasehold for a flat some time ago and the Freeholder of the building granted a long lease (125 years) to me. Some time later, I purchased the Freehold so I now own both the Freehold and the Leasehold, with the long lease still in place.<br> <br> I would like to sell the leasehold on my flat but I want to extend the term of the lease [and keep all other terms unchanged] to make it more attractive. Would a valid Deed of Variation to reflect my desire to extend the lease term be an appropriate way to achieve this? Would the Land Registry require any other evidence?<br> <br> My worry with a Deed of Variation is that since it operates to surrender the old lease and granting a new one whether this would pose issues for me in terms of title merging, since I am now technically both landlord/freeholder and tenant.<br> <br> Thank you!</p>

Good Morning Thamianos - if I have understood correctly you are trying to extend the lease on your own, namely as both landlord and tenant. <s>If so then that is possible as you are completing the deed in two different capacities </s>[Edit - please do seek legal advice]<br> <br> Land registration is complex, designed to protect legal and financial interests in property. Good Morning again Thamianos - just wanted to follow up on this thread as I've moderated my earlier response as I feel it's a Q that does require legal assistance/advice and my answer was too specific re it being possible.<br> It should have been more cautious as the issue is a legal rather than a registration one and you should seek to confirm if such a deed would be legal in the first instance<br> Apologies for not being clearer
