For historic abiding wayleaves agreed by utility companies with local councils prior to council house sale, will it be you or the council who will hold a copy of the contract ?

Mark - We are less likely to hold a copy of the contract even if it was submitted at the time of first registration of the property. 
 

Wayleaves, licences and other similar agreements made with utility companies and local authorities may be only personal to the parties and confer no interest in and impose no burden on the land itself.

Therefore at the time of first registration we note the interest on the title merely to give notice of its existence.
