Hi,

We bought a new build in 2022. Transaction completed, stamp duty paid and our solicitor had submitted land registration. We were not aware that the registration process was not completed until we got a redirected requisition letter this week Our law firm was no longer in practice (under intervention) and we are not sure what to handle this. 

The first question we can confirm we opted for joint tenant (solicitor missed to input this per our instruction I suppose) but the other two questions we cannot answer. We approached several solicitor and they cannot assist us. Can you advise what we can do now? Can we have a discussion with someone to go over the letter? We really want to get this solved and have our house registered.

Hi Jessica - happy to try and help here if you share the title number/our reference. But you may prefer to use our contact form to submit the details and that can be passed to the casework team so that they can engage with you directly

Thanks for your reply. I have submitted via contact form on Tuesday but no reply yet. 

Your reference is FB71D57. I want to at least clarify that we want to be under joint tenant first to avoid any restriction while sorting out the other matters.

Hi Jessica - noted and understood but it will be a few more days at least before you get a response via the contact form.
I can't see anything recorded though against the name/email address you have used here so what's the enquiry reference you received in the acknowledgement?

Hi Adam

The letter was supposed to address our lawyer firm AXIOM DWFM (letter sent to axiom@gordonsllp.com) which was no longer in practice and they redirected this letter to us, so you probably won't see my email on records (I never expect I need to deal with it myself). 

I used initial only in this forum for confidentiality reason. My first name is Oi which should match one of the transferee name.

Can I confirm nothing will happen to our registration and won't get cancelled for now? We tried our best effort to solve this and already in touch with Land Registry with our situation.

Hi Om Lam - if you have used our contact form to submit your details and linked it to the correct application then it should not be cancelled. You need to make it clear that you are acting for yourself now for example and respond to the points as requested.
You can certainly advise re how you wish to hold the property/title and if you are unsure re the rest of the request query that as well

Hi Adam,

The question is we are trying to find another legal representative to ensure our registration is being done correctly. Just not an easy thing to do when your previous law firm no longer in practice and I do not have access to what they have submitted (not now, still requesting from the intervention firm).

If we indicate that we are now acting for ourselves now, can we still get some legal representative later on if any law firm accept our case?

OM Lam - yes. The key is firstly contacting us to confirm what's happening from your end and if you are looking to appoint another firm then provide those details also. Just make sure you do it via the contact form and not this forum

Hi Adam, I just got reply from contact form previously sent. They said cannot discuss my case with me (the owner) but only my solicitor who initiated my application. The law firm is no longer in practice so what can I do? I cannot even handle this on my own.

Hi OM Lam - noted and looks like someone didn't fully check the pending application before responding.
I have added the email details and contact form to the case recorded and asked the casework team to consider and respond as appropriate

That's fine and understood but please don't be too anxious. The casework team will contact you as appropriate so please wait for that contact

Hi Adam,

We engaged a law firm to assist us with this matters and I believe they have replied on our behalf. How long it normally takes to get things cleared or feedback from HM land registry?

Hi OM Lam - the new firm have been in touch to confirm they are now acting and have provided a partial response to a request we raised in July. They have advised (2nd Aug) that they will contact us again with a full reply soon.

Hopefully they can confirm that for you and advise when they expect to be able to provide the remaining information. When they do respond in full we should be able to complete matters

Hi OM Lam - the 'new' solicitor contacted us on 29th July to confirm one detail. They also advised that more was to follow but as yet the 'more' has not arrived. I suspect they are waiting on the seller's conveyancer to assist
