Hi, I own a residential leasehold property out right, no mortgage, can I transfer the property into my sons name?

Hi Chris - yes if he's over 18 - Registering land or property with HM Land Registry: Change the registered owner name - GOV.UK

Hi, we owned a property which was registered in the names of both me and my husband. Now my husband has transferred the property in my name only. We have signed in the presence of a lawyer who completed all the paperwork. He advised us to post the original documents to HM land registry in order to get the property registered in my name only, but I don't know the address where I need to post. Please help me regarding this.

Hi Adam,
Thanks for the response. Is the address same for everyone? Does it matter where you live like in Birmingham or in Walsall? I am living at a different address and the property I want to register is at a different address.

Hi Neeru - generic address for everyone to use. We don't process applications on a regional/geographical basis anymore

Hi Adam, is there any fees which I need to pay for registration of the property in my name only? If yes, how much and how to pay? Do I need to post the application separately and pay fees separately?

Neeru - yes re fees and that's paid on submission
Here's the generic answer to someone wishing to do their own conveyancing/application

Application form in Form AP1.This guidance will help you complete this form correctly. There is also a "Youtube" video which may assist you.

Form TR1 should be used where the whole of the land or property is being transferred (including shares in the property). Guidance is available to help you complete the Form TR1 correctly there is also a "YouTube" video on completion of TR1 which may assist you. 

Evidence of Identity is usually required for all parties to the transaction unless they are represented by a conveyancer. See Practice guide 67: evidence of identity for more information and the options available to you.

Fees to register the transfer deed. Our fee order contains guidance on all our fees which are based on the value of the property or the share being transferred. To work out what you need to pay for your application, you can use our fee calculator tool available on our fee order page. Cheques or postal orders are payable to HM Land Registry.

Even if no money is changing hands, you should contact HMRC and check your responsibilities in respect of Stamp Duty Land Tax (England) or Land Transaction Tax (Wales). HMRC will provide you with a "Land Transaction Return Certificate" or submission receipt which should be sent to us with your application.

Hi Adam, I tried to follow the link and figure out under which scale my application will fall but got confused. One of the registered owners is transferring the property in the name of other owner. There is no money changing. Could you please help me to find how much is the fees. We have filled the TR1 form with the help of a solicitor. Thanks

Hi Neeru, Where there is a transfer not for monetary consideration the fee is calculated under scale 2. Assess the fee on the value of the property, minus the amount outstanding on any continuing charge and any new charge. Where a transfer not for monetary consideration gives effect to the transfer of a share in a registered estate, the fee is payable on the value of that share. 

For this type of transaction, use Scale 2 fees.

Hi Adam, I posted the TR1 form, ID1, and the postal order to the HM Land Registry on 23/11/2024. How long will it take to process, and will I receive any documents after it is processed? Thanks
