Hi Debra

how did you manage to get this resolved my husband and Are in a similar situation. We are 6 months in to trying to buy a property with our mortgage due to run out soon. The seller has a charge with Barclays outstanding on the property and says she is continuing contacting them and getting nowhere. Until reading this I thought she was making it up. We know the bank needs to complete a ds1. If you can provide anything that could speed our process up we would be so grateful.

I Emailed the CEO of bank which is not what you are supposed to do. but you do get a quick response from someone high up. They sorted it. But you must make sure where the charge is coming from. whether it’s the bank or something else that you did not know about. The bank did a more thorough search than my solicitor and found exactly where the £1000 charge came from. And .. Guess what.. It wasn’t the bank ( which my solicitor told me ). It was someone else . years ago .. who we managed to get to discharge it by filling in a form. I am afraid 2 things were a problem. firstly the solicitor did not do a thorough search , which cost us time and money. The buyer offered less because of delay. Second thing was the bank were slow in replying. almost a month. These things definitely Need to be done in advance of exchange day which is what happened to us. Solicitor was at fault in my eyes.

Hello, this is probably a new query but very similar to the thread above. My husband is executor to his late brother's estate (it's been going on early two years now).  The mortgage on the property that my late brother-in-law owned was redeemed last November 2023.  The Building Society in question confirmed they have sent the discharge forms to the Land Registry.  We are at the point of exchanging contracts on the property and the charge is still showing on the Title.  How can we escalate this please?  We've been chasing the Solicitors but getting to the point where we may lose the buyer if this goes on much longer?  What is the usual service level for removing a charge on the title when notified of the discharge?  Thanking you in advance for your help.

Hello Alison - I'd need the specifics, title number or address, to be able to check the details for you.
Most banks discharge their charges electronically and they complete in seconds.
If there's a delay I can only assume they've applied by post and the backlog of work has impacted, something's awry or wider checks are completing.
I'd suggest starting your own thread under Application and sharing the specific detail as mentioned. 
If you don;t wish to share the details then you can use our Contact form instead and the details will be private

Many thanks Alison - so submitted 21st Nov in paper form. Subject to lengthy wait time due to a backlog of work but expedited on 24th Jan and then processed
Unfortunately there were issues with the submitted paperwork and it took until 15th March for the lender to satisfy the requirements.
Wider checks are then required, including serving notice on the lender itself, and these don;t expire until after 7th April 
The lender can respond sooner but if they don;t then the application won;t be completed and the register updated until shortly after the 7th April

Thanks, Adam.  We’re waiting to exchange contracts and this has been unduly prolonged.  I’m asking my solicitors to chase this asap.

I would like a charge removed from my house we are in the process of mortgaging, the debt against the house was paid in 2017, the solicitor they employed put a charge on the house I paid the 75.00 in early April and am still waiting to get this removed. The said solicitor have been of no help saying that they cannot expedite. To put this in context, I have been a mortgage prisoner, never had the luxury of low interest rates throughout and now my interest rate is 9.25 and would really like to take my offer up so I can experience what it might be like to have something that is 5% lower than my current rate. How can this be expedited, before my mortgage offer expires.
