Hi, my husband and I are selling a house, title no: WSX208992
He was discharged from bankruptcy in 2010 and bought back his interest in the property. The trustees said they would remove the restriction (proof in an email), but they didn't. Now we're in a catch 22 situation as his bankruptcy file is closed and they are not interested in helping. We submitted an RX3 form to you with all of the proof that the trustees no longer have interest but have received a letter from you stating that our application is 'defective'... but it doesn't say why.
We can't let this sale fall through - Please can you let me know what is defective about our application?

Hi Alison - our letter dated 3rd Aug explained to your husband that we can't accept a form RX3 in such circumstances. We require a form RX4 from the Trustee in Bankruptcy
Our Practice Guide 34 explains how such restrictions can be withdrawn and I'd suggest speaking to the conveyancer acting for you on your sale for legal advice/assistance
