Hi,
Any help would be gratefully received.  My solicitor has sent an application to amend the Title Deeds (a tiny strip of land was sold nearly 90 years ago which the deeds do not reflect, even though the garden as it is, and always has been, will not be affected).  My house was ready to complete two weeks ago and then there was an application pending which was flagged up two days before completion. 
The next door neighbours' Son (who has Power of Attorney) submitted an application (which was incorrect and he has told me he has now withdrawn this application and my solicitor has completed and submitted the application last week to be expedited).  
Do you know how long this may take as my buyers buyer is getting 'jumpy'.  
The address is 50, Panfield Lane, Braintree, Essex, CM7 2TL.

Any help would be very much appreciated as myself and my mother are paying full council tax and heating on an empty house and the money is required to pay off my divorce settlement.

Hi Katie - I can see that the application has been approved for expedite so it will be processed as a priority, subject to any queries or additional actions we may need to take.

Hi Katie - it's been through it's initial consideration but the nature of the application means it has to then be considered by a senior technician to decide on what needs to happen next. 
Hopefully those next steps will be added this week and then we will have a better idea of remaining timescales 
Unfortunately this type of 'amendment' to registered extents can be problematic as there are various parties involved and the legal as well as registration requirements can be complex
Make a note to post again in a few days and hopefully we may have something more insightful to share

Katie - I'd be very surprised if a conveyancer/lender would proceed to completion until the issue was resolved. Someone has obviously spotted and raised the issue in an effort to amend/update the registered information so any conveyancer/lender would be risk averse until things were resolved I suspect - but very much a Q for your conveyancer rather than ourselves

Hi there. 
Is there any news on this, as the chain are constantly chasing me up, and I’m concerned of losing the sale. 
The neighbour is in agreement with the amendment (He put in an application last year, which he then withdrew, as apparently he did it wrong, so I paid a solicitor to do it properly) So there won’t be any disputes on the application

Hi K V - it is with one of our lawyers to decide on next steps and hopefully we will know what those are in the next few days. If all is in order then it could be a quick resolution. But if a site visit and/or wider checks are needed then the timescale will become stretched 
Post again on Friday and we may be able to offer a better idea as to timescales then

Hello,

just wondered if there was an update. My solicitor emailed me to say they have information that iit was passed to a case worker, was that before the lawyer or after? 
 

Any help/info would be very gratefully received please.

KV - the caseworker review comes first and the referral is to confirm decisions and agree next steps as appropriate.
Those next steps should be communicated with the conveyancer shortly I suspect

Hello K V - no update as yet other than we hope to trigger the need for a survey shortly. We have to make arrangements with Ordnance Survey to visit and make a report and that can take a little time to arrange
I am keeping an eye on it and will share when I know that process is underway

Hi

I didn’t expect that the OS would need to visit as the plans were already drawn in the contract from years ago and an illustration was done in 2021. 
 

is this a definite that OS have to visit?

Katie - it is a definite. In certain cases we need to match what has been supplied with the reality on the ground before completing matters

K V - once the survey has been requested OS generally complete it and report back within 2 weeks. How long after that will depend on their report and whether wider checks are then also needed
