My husband and I have jointly owned a property in London since 1982 which was formerly our home.  He has been diagnosed with Frontotemporal dementia in Scotland and is now resident in a care home in Scotland.  I was awarded Guardianship by the Office of the Public Guardian in Scotland in November 2023.  My London solicitor advises that this may not be recognised in England and that I should apply for Guardianship in England which will add another 6+ months to the process of selling the property which I urgently need to sell.  Will HMLR accept the Certificate of Guardianship and associated documentation confirming his illness and incapacity to act?

Jane - very much something you should be relying on your legal rep to advise you on as this is more to do with the limits of any Scottish Guardianship.
