Will land registry accept the application as we have the sellers TR1 but as there is a minor covenant passing the buyers signed counterpart has been misplaced and we have no copies? If we can provide written confirmation from the buyer that they agreed to the covenant, could that suffice?

Amit - all depends really but I'd expect us to require them to execute a fresh copy/deed. A 'minor' covenant doesn't really exist as they are all covenants and whilst some might see a positive/personal one as being different to say a restrictive one the reality is they are all covenants between two parties so both should be executing the deed

In terms of dating are we able to put the execution date in panel 3 and also an effective from date to avoid issues relating to back dating?

Amit - the deed becomes legal re the date in panel 3 so there's no 'effective date' elsewhere
