I am gifting my share in the family home to one of my brothers. The home is currently owned by myself 1/6, two brothers (1/6 each) and mother 1/2. On the AP1 form, do I just need to put my name and the brother who I am gifting it to or all the names? Do I just need to verify my identity or everyone? Thanks

Brendan - you all need to Transfer the whole of the legal ownership to the new owners as appropriate. So tall he current registered owners are the Transferors
You will all need to have your identities verified

Hi Adam, many thanks for your swift reply. Some more questions:

1. On AP1 panel 4, do I just put the market value for my % of the property I own or the full value?
2. On AP1 panel 6, do I just need to put my name or do I also need to put the names of my mother and brothers?
3. On AP1 panel 14, do I just need to put my name and the name of my brother I am transferring my share to or do I also need to put the names of my mother and other brother? If the latter, would the one brother be transferor and transferee and the rest of us transferor? My other brother and mother need to retain their current share of the property, so I am thinking they might also need to be both transferor and transferee?
4. On form TR1, panel 11, is this where I stipulate the transfer of my share to the specific brother and my other bother and mother to retain their current share?

Many thanks

Brendan - 1. Put 'Full market value £X'
2. Panel 6 - name(s) of whoever will be the NEW registered owner(s)
3. Panel 14 - all names so all the Transferors and Transferees - if any are both then just add Transferor and Transferee after their name
4. Panel 11 of TR1 is for additional provisions as appropriate so NOT the % shares. That information can go in panel 10.
There are notes that accompany both forms AP1 and TR1 to help you with their completion.

Hopefully my final question-I did look at the notes so I may need to seek legal advice here.

Panel 10 of TR1, box two indicates tenants in common in equal shares. We hold different shares in the property so what box would I tick for this for that to remain also stay as tenants in common? Would it still be this one and the equal shares refers to other rights? Thanks.

Hi Adam, I think I have resolved the above now by ticking the trust box (third option) and then explaining the specifics there. Is that correct? Thanks.

If I am to gift 50% of my primary home to a son, which form should I fill in, TP1 or TR1 or both?
