My husband and I are joint owners of a free hold property.  A Consent Order has been issued by the courts which transfer ownership of the property into my sole name in return for a lump sum payment to my husband.  The effective date of this change will be 1st August 2025.  My current mortgage ends on the 31.7.25.  I do not know at the present time who my lender will be after that date.
Could you the answer the following questions please
1.  Which forms do I need to use    AP1, TR1 and ID1?

2.  Which scale of charges should I use.  Do I use the value of the house or the agreed buy out sum?

3.  What is the best way to deal with the mortgage given that I don't know the lender yet?

Polly - forms AP1, TR1 and ID1 are the correct forms needed to transfer the legal ownership and apply to update the register
Form TR1 is the legal deed and the linked guidance explains how to complete it, inc the consideration and fees payable
Speak to the mortgage provider to establish what they require. You may find that they insist on your using a conveyancer

Can I go ahead with the transfer of legal title and deal with the mortgage issue nearer to the end of the mortgage agreement period?

Polly - that's not really something we can advise you on. If you try to transfer the legal ownership before your existing mortgage is 'up' then your existing lender needs to consent and may also insist you use a conveyancer as stated

Adam - sorry, my previous question was not clearly explained. Full legal ownership will pass to me on 1 August 2025 (Consent Order). My current mortgage agreement terminates on 31 July 2025. At the present time I do not know who the lender will be from 1 August 2025. Is there any reason why I should not apply for the legal ownership transfer now (to take effect on 1 August 2025) and deal with the mortgage issue when I have a new agreement (which will also start on 1 August 2025)?

Polly - ownership doesn't pass by way of a consent order. The legal ownership will have to be transferred by the two of you to just you. 
We don't deal with 'reasons' as to how and when you can change things/apply to update the register. We deal with the outcomes so when you complete a specific transaction you can then apply to update the register 
You can't do anything with us to then take effect at a later date. Hence you need to confirm with your legal rep what can be done and when it can 'complete' and once it's completed then you apply to us.
