We are acting for a client who is purchasing a lease which includes a flat and a garage. The lease is dated 1959 and it does not contain the usual provisions as current leases would. We want to surrender the existing lease and grant two new leases, one for the flat and one for the garage. Please could you advise whether there is a specific wording required in the surrender and re-grant which will extinguish the 1959 lease?

Harnit - from a registration perspective there's no specific wording. You'll need to decide on what wording is required to effect the surrender - our guidance can only extend to how to apply to register the deed/close the leasehold title for example
