Tenants in Common & Probate

My parents owned their property as 'Tenants in Common'. My father passed away, leaving his share of the house to my mother in his Will. Do we need to apply for probate? House and estate under IHT threshold.

Rachel - the legal ownership passes to the surviving joint owner so probate is not required with regards the property.
If Mum is now the sole legal and beneficial owner then she can apply to update the register and cancel the form A restriction, usually applied for when TIC created, as explained in our PG 6
