I am currently in the process of selling my deceased parents house and have hit a stumbling block. I notice a charge dated back to 1991  when my dad bought the house. A security agreement between my mum and dad and the secretary of state for defence. I have confirmation from Forces Help To Buy that the charge has been redeemed but still need the charge removed. How would I go about this? I have a buyer ready and this is the last hurdle

Richard - I would suggest applying to update the register using form AP1 plus a copy of the supporting evidence you refer to 
If you have a copy of the actual Security Agreement as well then that would be very useful also 
Once submitted you should then request expedition

Richard - it's not registered as a legal charge but as a Security Agreement . If you have or can get a form DS1 that may assist but it may not be necessary.
The key, in my experience will be the basis on which the entry was made and the Agreement itself. As we don;t have a copy on file your providing that would assist. And if you do have a copy then it's wording may help you to understand if 'more' such as a DS1 would be required.
Have you made enquiries of us through another channel perhaps?

I don't have a copy of the agreement but I know how it came about. My Dad was in the navy and used what's known as a Long Service Advance Payment to use as deposit for the property. It's called Forces Help To Buy now, they have confirmed that it has been redeemed. My solicitors are submitting an AP1 without a DS1.
Just wanted to see if there is anything I can do to speed things up as solicitors move to slow for me

Richard - understood. In such cases the application should include as much information as possible to link what is being submitted to the original agreement and therefore removal after all this time.
Once submitted they should request expedition to get it to the processing start line asap

My solicitors inform me that they only have an email from Forces Help To Buy that its been redeemed. Hopefully that's enough
