Hello,
We have jointly owned land on our close which as a close we look after as a community association. 2 people are registered as trustees. However, the 2 trustees registered are now both deceased. On transferring titles to 2 new trustees, do you require probate to process the application or are death certificates enough? Our solicitor is advising to seek a grant of probate, is this the correct thing to do? There seems to be no trust deed in place.

Hello Jerome - if the title has been registered in their names then probate will be required. Do rely on your legal advice here
