Sale of Property

The above property is owned by three people as Tenants in common

One of the owners has died and the other two owners want to sale this Flat

Do we need a Probate to sale the Property or the other two can sale it on Trust on behalf of the deceased

Umesh - the legal ownership passes to the surviving two so probate is not required to deal with the property.
The surviving two can sell and then deal with the purchase monies as appropriate with regards to the trust you refer to
