Title No HD25357

One of the joint owners (Wife) of this property died in June 2019

We now want to remove the name of the deceased . Do we need a Probate as there is a restriction or we can submit death certificate and form DJP and the property can be in the Sole name of the Husband

Many Thanks for your help in this matter

Umesh - form DJP plus death certificate is needed to update the title re the death. Probate is not required as the death certificate is proof of her death.
If by 'sole' name you also mean that the form A restriction needs to be removed as the husband is now the sole legal and beneficial owner, then see PG 6 section 7 for guidance re forms RX3 and ST5

Thank you for your prompt reply

My apologies . I should have mentioned that the husband has also died recently. Is the procedure still the same in removing his wife's name from the title deed

Many Thanks for your help in this matter

Umesh - if both have died then probate is needed for the husband. You'll need to decide, or the executor will, what happens next for example register the executor in that capacity and note the deaths or something else.
See our online assisted guidance which takes you through what's required depending on what decisions have been or are made re the ownership
