Hi there my solicitor sent the paperwork to land registry for the lease on my property to be registered in my name on 13 June, it was received by the Business Gateway team. He asked for it to be prioritised as I'm remortgaging. When he asked for an update today he was told that it is can not be done as it is waiting on another flat in my building to registered first.   If this doesn't get prioritised I won't be able to remortgage. What can I do to get this prioritised in time for my mortgage?  Thank you so much
 

Hi Jane - I can't see any recorded contact to expedite or request lodged with the application itself. I assume they must have rung and no record was made or there has been some misunderstanding
If there's a genuine urgency we would normally grant such a request but whether it can be processed would often depend on whether the landlord's title had prior applications against it that may hinder progress.
Whilst that is the case here it looks like the prior application may have been submitted incorrectly so will need to be cancelled, which in turn frees up the way for the lease you are chasing.
I'll flag with casework colleagues to expedite it and action as appropriate. Everything then hinges on it being in order to then enable it to be registered

Hi Adam thanks so much for getting back to me so quickly. I have to say I'm really impressed with this service!

If the prior application for flat 3 was submitted incorrectly can your casework colleagues cancel it? Or would I need to contact the owner of flat 3 and ask their solicitor to cancel it?  If there is anything I can do to help the process so that I can get my mortgage done in time, I'll do it.

My solicitor forwarded me a document from Land Registry which says 'Priority protection' on it.  I can't attach it here but the content of the doc is:

Hi Jane - nothing for you to do re Flat 3. The casework team will sort that when they process the expedited case.
Thanks for the additional details but you'll notice I'd already identified it hence quoting the new provisional title number allocated to Flat 2
You need to stay patient for the coming days and cross everything that your own application is all in order. If it is then it can be registered but if something awry then we will contact the conveyancer as appropriate.
