Hi Rebecca - the conveyancer has replied although it doesn't read as being conclusive and they refer to contacting the lender as well. Their reply will though be referred to the casework team to consider&#160;<br> TY610863

Hi Rebecca - yesterday's response from the conveyancer was to provide further clarification. That response has been referred for further consideration by the casework team. They will do that asap but nothing to update you on as yet and I suspect we may not have more to share until Monday at the very earliest<br> TY610863

<p>Hi Adam,&#160;</p> <p></p> <p>Thank you for your response on Friday. I was hoping whether you would be able to provide some clarification please.</p> <p>We have been informed the reason for the requisition initially on this case was to do with a sub-charge. Our sellers solicitor responded the same day and was informed their response was insufficient. They then provided more information Tuesday and then Friday we were told there needed to be further clarification and this was being reviewed again.&#160;</p> <p>Just to give you some context, our sellers bought some land in front of the house we are buying,&#160;as this was left out of the title deed and so was the rights of way information in between the house and this bit of land when our solicitor reviewed the draft contract. Their solicitor dealt with the transaction and provided a TP1 form to land registry, which was then expedited on the 29th April.</p> <p>The clarification around this raised requisition I believe is to do with a DS3 form. However, our sellers solicitor believes they do not need a DS3 form as well as the submission of the TP1 form and they have went back to the lender and the lender has also confirmed that they do not need one too.</p> <p>I was wondering whether you would know if they do or don’t? As this seems to be what is holding up the processing. House No 21 on the same street went through the same process in January and they did not need a DS3 form either.&#160;</p>

Hi Rebecca - our current position is that they do need a discharge re the registered legal charge. Where land is being transferred and it is subject to a registered charge, then it needs to be discharged (removed) from that secured loan. That's a standard requirement<br> If the seller/lender are suggesting otherwise then hopefully they have explained why&#160;<br> TY610863

Land registry, however, have then said for a CN1 to be completed instead. That being said, our sellers solicitor also believes we do not need one of those and has went back to land registry, I am told, with this information.&#160;<br> &#160;</p> <p>Will this be confirmed by the casework team again or a senior officer? As we are wondering how long we could be looking at if we just need confirmation that last form is not needed too.</p>

Hi Rebecca - they have queried the need so that will need to be referred back to and considered by the senior officer again. Same referral process again which is frustrating but will flag with the casework team again to see if they can assist<br> TY610863
