We have been trying to buy a property for the last 6 months with nothing but set backs, we were led to believe we were near to completion however a charge was found on the sellers side. The bank she had previously had the mortgage with had told her they would get the charge removed and this would all were sorted in 3-5days we are now 2 weeks past this deadline and no further contact.From reading online is there not a form that she can complete and submit to have this removed more efficiently? Or has anyone been in a similar situation? I feel as though we are being led down a rabbit hole.

April - most lenders remove their legal charges electronically so it's a computer to computer scenario and once they his submit the charge is removed in seconds.
There's no simple form for the owner/borrower to complete as it's the lender/creditor that needs to be removing their own charge
Do you have a title number or postal address to share please?
And whilst this is a forum so others can participate it's highly unlikely anyone else will comment. We use the forum for helping with general enquiries re HMLR matters so there's not a community in play for example

The title register ref number is 1000003940015

April - that looks like a payment/download reference rather than a Title number which would start with a couple of letters and then 5/6 numbers

April - many thanks. So no application as yet to discharge the legal charge. So very much down to the lender to apply using form DS1 either by post or electronically as explained.
The seller needs to chase the lender for you

Thanks Adam is it possible that the seller could complete a cd1 form to submit as she is finding it impossible to get through to anyone at the bank with numerous failed attempts?

April - I don't know what a cd1 form is so I doubt if it's something she can do. The lender has to discharge their own legal charge using a form DS1.

Sorry it was meant to say a CN1 could the seller not submit this to apply to have it cancelled on their behalf?

April - no sorry needed and no as it's a form DS1 needed to discharge a legal charge. Form CN1 is used to a cancel a noted interest

Hi Adam are the attached proof that can be used with a CN1 to remove the charge? Sorry for the 100 questions. The charge was paid back in 2007

April - No. To discharge a legal charge we require a form DS1 executed by the lender as previously explained

Hi April - they've now removed their legal charge so the updated register is available online as and when needed
