Hi there, 
We are just about to exchange contracts on a property that seems to have a legacy equitable charge on it. The sellers solicitors have apparently posted a physical hard copy form off with the relevant paperwork to get this removed. Can you please confirm the form has been received?

Our mortgage offer is likely to expire if this isnt resolved soon, plus we have a tenant lined up to move into our current home so we are really pushed timewise. 

It is even more complex I'm afraid as the charge was apparently transferred over from a previous home owner of Tower Close and wasn't even the fault of the current owners apparently. Is there any way we can find out the details of the charge so we can find out exactly where we stand?

Plus, it details that it was created by an interim charging order in favour of Northern Rock, but as they no longer exist where do we stand? 

I'd really like to know if our conveyancing solicitor and the sellers solicitor can do or supply anything else at this stage to expedite it? We were told it would be marked as urgent.

Hi Alison - received 3rd May. It can be expedited and they should make a separate request for that. I can see they have included a request to expedite with their submission but that would not have been seen until the case was processed so the opportunity for urgency would have been lost. 
I'll flag with casework colleagues to make it an expedite now following your post. It should be processed asap but everything then hinges on it being in order. If it's not the casework team will contact them as appropriate

Hi Adam, I cannot thank you enough for your assistance on this. I will inform our solicitors to keep in touch closely with the sellers solicitors and hopefully we can get the matter resolved swiftly so the mortgage offer stays in place. I appreciate your input and the casework team expediting it and keeping them informed.

Hi Alison - it's been processed but we can't remove the charge as yet. We've gone back to the conveyancer to request more from them so the ball is in their court again to try and provide the required information/evidence as appropriate.
I suspect they won't be able to provide what has been requested and will simply refer to the information already provided. That's likely to mean it will be referred internally to one of our lawyers to take a view and decide next steps.
The complexity, which you referred to, and there being no 'simple' answer it seems is likely to prolong matters I'm afraid

Hi Adam, 

Thank you for your update regarding how to get logged back in, my last password reset seems to now work this morning!

I wondered if you can see if there is an update from your side yet? Hoping the senior Caseworker or lawyer have had an input 🙏 

When I spoke to someone early in the week they said by Thurs/ Fri there will hopefully be an update. 

We are likely to have our tenant cancel on us this week if we can't put a timeframe on it. Thank you in advance

Hi Alison - the conveyancer responded to our request for more and the case is now with one of our senior technicians to consider the new evidence submitted. Hopefully that will happen shortly due to the case's expedite status

Hi Alison - nothing to update on as yet I'm afraid.
The complexities involved mean this is not an 'easy' solve but I shall make a note to check again on Monday to see if we are further forward. Not ideal I know but I can't be definitive until next steps approved/taken
