Second charge

Asking fir a friend. She is just remortgaging and taking on house herself after divorce. There is a financial settlement which directs this. Turns out ex has put second charge on the house. It doesn't show on LR. How can we find out the company who has put the charge on. She has received no letters regarding the charge from lender nor LR. Any ideas please? 

Hi Jo - not really as if it's not been registered then the charge hasn't been secured/registered against the title. I'd go back to whoever has told you to establish the precise facts and then seek legal advice to confirm what impact, if any, it has on your friend/the property

as part of a fact finding exercise to establish certain facts, the above property shows movement on 17/03/2023, this was a mortgage settlement to Lloyds Bank.

can you confirm the settlement amount to release the charge.

Claire - we are not privy to the settlement figure and as such it is not registered or recorded. The lender simply completes a form DS1 to remove their legal charge and that merely states the date of the charge itself
