Hi Adam, 

Hoping you can offer some advice - we made an offer to our neighbour to buy a small part of their garden that backs on to our new build garden - this was six months ago and he didn’t get back to us, so assumed he didn’t accept. Last week we started garden works and he comes out to tell us he accepts the offer. 

We are now in a position where we want to buy the land but don’t want to delay garden works as we move in at the end of the month & want the garden to be secure for our children. 

Seller has told us we can carry on incorporating the new part of land into our garden before it completes legally as this could take months & is happy for us to put in the new boundary wall and fence. 

A surveyor has been out to measure the existing land already - with the seller’s signed agreement, can we now install a new boundary wall and I assume the surveyors come back to re-measure the new boundary as part of the sale?

Hi Hayley - all sounds logical to me but we wouldn't be involved or able to advise until the actual sale completes.
What you/your neighbour do on the ground is a matter between the two of you but always best to get something in writing to confirm intentions just in case something changes for any reason halfway through the works
If he's selling you part of his land then our online guidance explains how that part can be transferred (TP1) and what's needed. If he has a mortgage then his lender will need to be involved/consent also and likely to insist a conveyancer is involved

Hi Adam,

Great - just wanted to check that we wouldn’t disrupt land registry processes if we put it a new boundary wall before the sale is officially complete. 

We have solicitors managing the transfer of the land which is great.

Hi Adam,

Hope you are well.

I did the above and applied to change the address on the land registry document - I received an email to say it will be complete by February 2026..

I am currently remortgaging and have just been told that they won’t complete the remortgage until the pending application is complete!! Is there anything I can do to either get the application speeded up, or at worse, cancel it so it is no longer pending?

Sorry replied to the wrong thread. The thread I was referring to was when I asked if I can change my land registry document to match the new road name for our new build. Hope that makes sense now
