My neighbour has agreed to gift me the top of their garden which is overgrown and full of rubbish! It’s about 4m x 2. I don’t really want to involve a solicitor as it’s going to cost me to clear it but do I need them to put in writing they are gifting it? If so, is there a special form for this? Thanks

If the neighbour's property is mortgaged they will need their lender's consent

They said I can have the bit of garden as long as it doesn’t cost them anything re solicitor fees etc so if I’m completing the paperwork, do I put their details as the applicant and transferor as it’s their land?

Nicola - no as you are the one applying to register a transfer to you.
Do take some time to read through all of the guidance, forms and explanatory notes. It's all there to help and I would suggest you start with the form TP1 as that's the one you will both need to confirm/execute as directed. And then the form AP1 (application form) which is what you would complete and submit

I have prepared a plan (an edited version of the original title plan). Does this need to be signed by both parties ? I am the applicant but not the transferor.

I would suggest taking a look at our guidance for preparing plans for HM Land Registry applications which contains information about who needs to sign a plan to a transfer (see section 5).

Thanks Joel. Understand now. One more question regarding the AP1. If my neighbour does not want to be paid for the small strip of land do I just right “0” in section 4 in the price paid/value.

Nicola - you can state Nil but we will need a statement of value re the land. A covering letter confirming the current market value is £X or 'Less than £X' would suffice normally

If I am not required to send verification of ID because the value of the land is less than £1000 do I leave boxes 12 - 14 blank on the AP1? Thanks

Nicola - if identity verification is not required then you can leave panels 12-14 blank
