We are selling our house which is freehold, however in Part C - charges register it refers to a lease dated 1947 for 999 years and names 2 people. There is no leasehold number or other information. How do I find out more detail as it is impacting on the sale of our house. Our solicitor has asked us to go back to the solicitor who sold us the property 30 years ago to check if the leasehold title is registered. Unfortunately, I can't recall which solicitor we used back then and have no paperwork. Is there anything else I can do to find the information out?

Hi Alison - Thank you. 

I have examined the title register and, as you will have seen, there is a note added to the entry about the lease which states that HM Land Registry does not hold a copy of the lease.  There is also no title number indicated which means that the lease has not been registered on its own right with us. 

Normally such situations arise when the existence of a lease will have been brought to our notice as part of the deeds submitted when the freehold was first registered.  If there was no specific application to register the leasehold title, we would add a note about existence of the lease to the freehold title register. 

The entry appears to be on the freehold title register since it was first registered on 14 July 1981.
