Hi I'm hoping I am posting in the right place.
We are at a standstill with completing our house sale as we are in the process of trying to get a charge removed from the current owner.

The title number is WA692187

This has apparently been expiditated but we are just hoping for an update please as our mortgage offer is running out.

The charge is for INN Partnership. Nothing can go forward until this is completed.
Kind regards.

Hi Danielle - application received on 27th June but as yet not made an expedite.
Unfortunately the lodging conveyancer submitted a request with the application and so that won't have been seen until your post
We ask applicants to request expedition through a dedicated channel to ensure prompt action - Request an expedite - GOV.UK
I'll get it made expedite now

Thanks so much for your reply and for doing that for us. We had been told this had been done so im so glad you was able to do this for us. Just to confirm you have been able to expedite it ?

I'm just wondering if you have a possible time frame please ? I tried my best to look for this information but wasn't sure if I was looking at the correct information.

Kind regards

Danielle - it ahs been expedited.
Expedition isn't a magic wand but it does get the case to the processing start line sooner than it would have done. Generally expedited cases are processed within 10 days but often much sooner. Everything then hinges on it being in order of course
Make a note check for an update on Wednesday and I can check again for you

Hi Danielle - good news is that progress has been made but bad news is we need more from the conveyancer. They have been sent a request for more and once they respond in full hopefully matters can progress quickly
You'll need to contact the conveyancer to confirm details

Thanks so much for letting me know.
I've contacted them.
Could you tell me if its complex what needs to come back please?
Just so I have a rough idea if this will be resolved soon or not. As I feel like time is really ticking now with our mortgage offer.
kind regards

Danielle - I can't share specific details and that would be for the conveyancer to confirm for you.
All I can say is that it doesn't appear to be a complex request providing they have the required information

Hi Adam,

Thanks for all your help so far.

Unfortunately I dont think the conveyancer can gather the information required that has been asked of him. He has emailed the liquidisation company again to see if anything else can be put forward by there part

I feel as though nobody really knows what to do in this instance as both our estate agents and the sellers socilsitors have said this is nothing they've ever come across.

I was just wondering if you could shed any light on next steps if they cant provide the evidence required please?

Thinking we will probably have to pull out at this stage

Kind regards

 Danielle

HI Danielle - I'm sorry to read that. If they can't provide the evidence as required then the application will ultimately be cancelled
The request as issued explains what's required in some detail and includes the option to return to court to have the order dismissed - ultimately if they can't get anything else then that's often the only remaining option
I would suggest speaking to your own conveyancer to confirm options

Hi Adam,

I hope your well. I have spoken to the liquidation company myself as i found the information and contact details on companys house.
The lady who i spoke to said the liquidisation account is closed so they have no signing power to fill out any forms and theres nothing they can do and it lies in the hands of land registry.
I was just wondering if you know what happens in this instance please ?
I know the sellers socilsitors have asked to speak to the liquidisation companies socilsitors and are still waiting for a reply. But i know the lady i spoke to was quite confident there was nothing the liquidisation company could do with the account now being closed.
sorry again for all this.
kind regards

Hi Danielle - no apology needed. Whilst I understand the comment that it's in our hands the reality is that it isn't hence the contact made with the conveyancer to explain what's required
That contact explains the options available to them and what we require from them to enable us to update the register as applied for
If they have no power to sign forms then the other options exist inc returning to court to have the order dismissed
The alternative is to consider what happens to the debt when the creditor goes into liquidation. Who has an interest in realising that debt so that it is paid off for example - all legal considerations for the conveyancer to resolve rather than us

Hi
Thanks Adam.
If this is taken to court are we talking about months waiting opposed to days/weeks ?
nobody is telling us anything and it feels like this house is slipping out of our fingers.
I've tried everything possible in my power to do what I can do. Nobody else seems interested as i expect everyone else has written this off as a lost cause.
kind regards
Danielle
