Hi. I am in the process of purchasing a house with my boyfriend via part-exchange with a developer.
The property we are part-exchanging was previously shared ownership and we have recently completed on purchasing the rest of this property to then be able to part-exchange. The land registry application has been submitted and has been expedited (approved too).
Could you please let me know an expected timeline for when the changes to the land registry will be complete as this is delaying our ability to complete on our new property?

Hi Phoebe - submitted 17th Sept. Expedited 18th Sept. Unfortunately there are prior pending applications against the seller's title so there will be a delay. This has already been communicated to the conveyancer
I will check with the casework team to see if they can help progress matters but much will depend on whether the prior applications prevent that from happening

Hi Adam. Thank you. Are you able to advise how we could get this done any quicker or an expected timeline? Does the seller (I assume this is the housing association) need to do anything?
We are expected to exchange contracts on the 14th October and were hoping to complete on the 18th.

Hi Phoebe - no on both counts until the casework team have reviewed the prior pending applications and decided whether your later Expedited one can be completed
Once we know whether it is possible to do as above then we will have a better idea of timescales

Hi Adam. Okay - that is a bit concerning for us due to the expectation of exchanging and completing in the next couple of weeks. Can you advise when the casework team will be reviewing these prior pending applications?
I think the previous application that is pending is due to a merger of the housing association back in May/June. The house was previously owned in shared ownership with Arcon Housing but they were taken over by Bolton At Home.

Hi Adam. We have been told by our solicitor for our house purchase that we cannot complete on the part-exchange of our existing property for the new one until the land registry has been updated. We were due to do this on 14th October and this has really caused an issue for us.
Is there anyway the caseworker can review that previous pending application urgently?

Phoebe - the prior application relates to another flat/plot lease and not the issue you referred to.
The casework team are considering next steps and I will share that outcome once known

Hi Adam. Thanks for coming back so quickly. I'm not sure what this could be as it is a new-build property that was bought on a shared ownership basis in 2022.
Is there any other information you can share on what this application is?

Phoebe - it's a busy landlord's title with multiple new leases being registered. This is just one of those and with our current backlog and lengthy wait times these things can be delayed.
The key here is for the casework team to identify whether the pending application(s) impact in such a way as to prevent your new purchase. These older applications date back to July 2023. Your application was submitted on 17th September 2024.
I'm unsure what other information would be of any use to you at this stage.

We weren't aware of this existing application(s) until this week and so we're now a bit blindsided by this. When will the casework team look to identify if these applications will prevent our new purchase? We're now sole owners of the property and is no longer on a shared ownership basis anymore so surely the previous application is no longer relevant and our application can just be updated.
We are on a deadline to exchange by 14th September and so this would need to be resolved by then.

Phoebe - your conveyancer would have been aware of the prior applications at the time of completion. And will also be aware of how 'priority' works re submission of such applications and how they are invariably processed in that 'priority' order.
I already understand and appreciate the urgency hence reaching out to the casework team to update me and to assist if possible. We now need to wait for them to do that and advise as appropriate.

HI Phoebe - good news is that we have been able to process the application out of the priority order I referred to. The bad news is that is incomplete and we have contacted the conveyancer for more information. You'll need to contact them to confirm and to clarify what's still required

Hi Adam. Our conveyancer has now supplied all the required information back to the Land Registry. Could you check that this has been received and can be processed ASAP - as previously mentioned, we are on a deadline to have this completed in time for exchange on Monday 14th.
