My conveyancer has requested expedition to transfer out plot 305 59 Green Meadows Filey YO14 0FL from title NYK273530.  The expedite was approved on Thurs 9/5/24.  How is it going please?

Sue - I'll see if I can get an update from the casework team as to what progress has been made. The plot sale is out of a very busy developer/seller title with a number of pending applications so progress can still be slow, even with expedition unfortunately

Thanks for that, not the news I was hoping for.  But better to know than be wondering.  What is NYK510995?
I don't think I'd ever appreciated that expeditions can only forward to the back of existing waits on a particular title.

Sue - on busy new build titles things can get complex and delayed when numerous first time plot sales have not been registered. At the same time there are often other pieces of the development jigsaw also in play such as applications to register specific deeds/agreements re utilities and more. The numerous applications can then stall progress for some unfortunately.
The title NYK510995 is the provisional new title allocated to your Plot. When the registration is completed that's the 'new' title for the specific plot/property and which would then be used for any future purchase or mortgage for example
Expedition is a fast track tool to reduce the wait time. In the most simplest of ways it is a means of getting the application looked at and started much earlier than for example the average 14+ month wait time it might have had.
What expedition doesn't do is wave a magic wand over things and hey presto the plot is registered. Once it gets to the processing start line it then has to be in order and all the registration requirements met. That's where the processing really starts and that also has to account for all the prior applications still pending against the developer's title.

The problem is that the property has been sold SSTC and another purchased SSTC.  The sale and purchase is being conveyed at the moment and lack of title is obviously a catastrophe for the sale and the whole chain.  Everyone, solicitors included, have been reading the 10 days as "10 days maximum". 
Can the casework team say when NYK510995 could be registered?

Looking at the TP1 again, hopefully it may not be as bad as I fear.  The development was built in 3 distinct phases over a period of over 10 years.  The TP1 I am asking about only refers to NYK273530, NYK300128 and NYK411530.  These are only concerned with the third phase which is where all the newbuilds are - the rest of the development has been going for some years.  We must be the first people to move on from the recent newbuilds, so with luck there won't be too many applications ahead of us in the queue affecting the title numbers in my TP1 application?

Sue - totally understand and appreciated but unfortunately they've interpreted the 10 days aspect incorrectly.
The online guidance explains how "if we approve the request, we aim to process the application within 10 working days, subject to any outstanding applications or requests for information (requisitions) that need to be completed first."
So the 10 days is an aim as I have explained above and the conveyancers involved should both be aware of that as well as the impact of the pending applications on the developer's title and how they can/might impact on a later sale for example. 
The update they will provide will give you an idea of whether we can progress it swiftly or not. So that's essentially an answer to the first Q as to whether the prior applications impact in such a way as to make processing the plot purchase impossible at this stage. 
If it is possible as the prior applications have no impact on the specific plot then the next stage is can it actually be processed and completed. That essentially means has your conveyancer submitted everything needed to enable it to be registered and there are no issues re quality of their submission. 
So we need to get past the first update before trying to establish timescales

Thanks Adam.  I am totally confident that no past applications affect Plot 305.  I am also confident that the TP1 that was completed by the buying and selling solicitors when the property was purchased on 22/2/24 would have been perfect.  The buying solicitors at that time are the proposed sale solicitors for me this time and it is they who have submitted the expedition request that was approved on 9/5/24.  The solicitors are Gilroy Steel, The Old Town Hall, Buckingham.
Will that get it past the first update?

Sue - if it's as you suggest then yes but it's all about 'HMLR confidence' at this stage rather than yours. I would not be making any timescale decisions until you know if the first stage can be passed at our end. If it does then processing can start and we then have a better idea as to whether your confidence in the conveyancing is warranted

Thanks Adam.  I'm happy with the theory but what I'm trying to ask now is where is the TP1 application for NYK510995 in the process now, is it being looked at for first stage yet?

Sue - the good news is that the casework team have been able to process the application. The bad news is that the paperwork submitted is missing some information re a restriction on the seller's title. The conveyancer has been contacted with a request to supply. 
Hopefully your confidence will be such that they already have the required consent but simply forgot to lodge it or they have a swift response. So the ball is in the conveyancer's court and hopefully they can confirm and clarify the specifics for you

Adam - thank you for this update.  I'm sure this will just be a simple oversight, there's nothing special or different about our plot. Our solicitors will be on it and we'll follow up with them.

Sue - they replied just before midday so the case will b referred back to the casework team to review their response and next steps. That should happen asap due to the expedite status

Thanks Adam.  The conveyor told me "the Land Registry can proceed. As they only raised the one query I am hopeful that there won’t be any more as they usually review the whole application and raise all queries at once"

I do hope there are no more queries and it'll soon be done.  Hope it's OK if I ask again later for another status check.
