Good Afternoon - I am waiting to have an IVA restriction removed from my Deeds to allow me to complete a Re-mortgage and I was trying to get an idea of the timescales for this to be completed.  I have been advised the application was made on 6th November - postcode LE12 7PW - Thanks in advance

Good Afternoon Dean - they/you need to request expedition to ensure any wait time is as short as possible. Otherwise wait times can be lengthy and on average around 4 months

Good Morning Adam - really hoping you can help me here.
My Solicitor has come back to me to say they cannot expedite the request it needs to be done by the restriction holder.
The problem I have is the company I held my IVA with (IVA completed in 2015) rebranded themselves in 2016, then the company was taken over in approx 2020 and then rebranded again in approx 2021.
I actually have no idea who has actually submitted the request. 
Is there any info you can provide me with so I know who to contact ?

Dean - anyone can effectively request expedition if they have sufficient reason(s) to do so. But I know some firms can be averse to doing so although unsure as to why that might be.

Hi Adam - that would be really appreciated.  I am lost as to why the company didn't apply to have the restriction removed when the IVA was settled in 2015.  Just some additional info for you if it helps - I am re-mortgaging and applying to have my ex-partner removed from the Deeds and also to pay her her remaining financial entitlement - she has my children living with her and is going through some bad financial issues right now so I am keen for this to be completed ASAP for their sake.  Also, my re-mortgage offer is already 2 months old so am keen for this not to expire and have to start again.  Thanks again

Hi Dean - they very rarely do as it's not part of their own process to do so.
Noted and appreciated re your personal circumstances but, and I don't say this to be harsh, but they have no impact on the registration requirements/process. Expedition will get the application to the start line quickly but everything then hinges on it being in order. If it is then it can also be completed quickly but too soon as yet to confirm.

Hi Adam - Solicitors have provided me with a contact so I have asked them to expedite - we'll see if they do.

In the mean time thank you for the information and for flagging the request.

This system / process for being able to communicate with someone and receive info / updates is really helpful.

Hi Adam - do you know how long it takes until the document you can access online is updated ?My solicitor confirms that the Transfer is complete and remortgage is complete but when you access the Title Deeds document online (£3) it still shows both parties names on there - thanks

Hi Dean - The original application to remove the restriction has been completed and the register updated. The new application which includes a transfer was lodged at HM Land Registry today.

Checking Progress
If you used a conveyancer then they are often best placed to track progress using their secure portal to monitor the progress of applications and check the Estimated Completion Date. This is a date by which the application is likely to be completed. It is not based on the individual application but is an estimate of when the majority (90%) of that application type will be completed. It’s only an estimate, but by continuously collating data, we know how long it takes for different types of applications to be completed. 
Expedition
If you think your application is urgent, because the delay is causing hardship, or is holding up a following transaction, your conveyancer/you can ask for it to be expedited. Your conveyancer can again use their secure portal and submit documentary evidence to confirm the urgency. If you have access to such evidence then you can use our contact form to submit the request.
If you ask us to 3expedite it then you must clearly state the reason and attach any supporting evidence. Redacted versions of documents that contain commercially sensitive information are acceptable, provided it remains clear what the document relates to. In all cases, we reserve the right to refuse requests or to ask for additional evidence if we consider it appropriate.
If approved, we aim to process the application within 10 working days. This does not mean that in all cases it will be completed within that timescale as it still has to be in order and pass any necessary checks at our end.

If there is no linked transaction or hardship, then we would ask you to review our online guidance and not to contact us now as doing so will only delay the urgent work being done. Your application protects you and often it is a case of waiting until we contact you or your conveyancer as appropriate.
