Original commercial lease for 9 years ended in May 2023, and a renewal  lease was signed for a further 5 years ending in May 2028.  The renewal lease expressly incorporates the terms of the old lease and it is attached to the new one for reference also.  The old lease was registered with HMLR and is still showing on the Register,   but am not sure if the renewal  lease should also have have been registered last year?

Anne - it all depends on whether the renewal lease is an extension of term of the existing lease (i.e. incorporating and extending the existing registrable term), or merely a new lease in its own right (albeit to the same tenant) taking effect after expiration of the existing lease but not registrable in its own right as it’s only 5 years.

Have a read of PGs 25 and 28 for guidance depending on what the specific circumstances are
