Hi There, I'm buying a house with a title boundary issue that has an expedited possessory title application in process. The small front garden, which borders the public road and is the only access to the front door, is missing from the plan. The application is HG7DF72.

I've been told by my conveyancer that the OS surveyor has been at the property today. My question is how long is the rest of the process is likely to take? I'm concerned by the wider checks at Stage 3 as there seems to be varied information on how long this takes.

Hi Madeleine - we need to wait for the OS report to be submitted and then a decision is made as to whether that third and final stage is required or not.
Timescales will vary and until the wider checks are started we can't be definitive re timescales but where the land is unregistered notice periods are generally 15 days
So as things stand we ned the OS report and then a senior technician to review the report/case as appropriate so still some time to pass yet

Hi Adam

Thanks very much for getting back to me. If I get in touch again in week for an update is that enough time for the report to be submitted and a decision on Stage 3? We are waiting to exchange on both sale and purchase and this is the last thing holding up the transactions, I want to be able to give my buyers a realistic timescale as soon as possible.

Hi Madeleine - you can post again next week but I suspect the wait will be longer than that. Wait times for referrals such as this re adverse possession can be lengthy, 3-4 weeks.
And if more is needed and the usual wider checks required then the wait time will be longer also. You/your conveyancer will need manage expectations as appropriate as I suspect exchange/completion should be a little way off yet.

Thanks again for your responses. Just to clarify, we're looking at 3-4 weeks for a case worker to review this on an expedited application?
