Hi,

We're purchasing a property and understand that there is an overlap between the title plans K254754 and K791652 (one belonging to the seller and the other one a neighbour). The seller's solicitor (Brachers) has had their request expedited and we understand that it's been referred to a senior level. Land Registry advised last Wednesday that it would be actioned within 3 working days but we are still without an update. We've been told that our buyers will pull out if there isn't a positive update soon and our mortgage offer also runs out in a few weeks.

Please help as we really need to have this resolved ASAP to ensure the house purchase goes ahead.

HI Beth - things are being progressed but due to the nature of their application it needs referring to one of our lawyers to approve/agree next steps as appropriate
I'll keep an eye on it and update you again early next week when hopefully we will have a better idea of what's left

Hi Adam,

I understand that the sellers solicitor provided the requested further information on Monday. Is there any idea on how much longer it’ll be? We’re getting desperate as time is not on our side due to buyers at the bottom of the chain threatening to pull out.
 

Can I also ask why Land Registry refused to merge title plan K791652 with K332688? This means that our solicitor will now need to check that our mortgage lender will still lend as the house will have 4 title plans.

Hi Beth - appreciate things will be stressful. 
The casework team had to contact the conveyancer to confirm a specific issue and that was on the 2nd June. They have replied and that reply and the requested amendment is now back with the lawyer to consider 
The request was to amalgamate titles but at this stage that has been refused although not as yet confirmed.
I'll ask the casework team for another update once escalated on referral

Hi Adam,

Thank you for replying and I’m assuming that the lawyers haven’t looked at the reply this week? If our chain doesn’t collapse before, our mortgage offer expires in 2 weeks so really need this resolved ASAP.

Regarding the amalgamation of titles I don’t fully understand your reply. Does that mean there’s a chance they will still agree to amalgamate?

Hi Beth - the conveyancer replied on the 3rd and the case was referred again today
I don't know if the request to amalgamate will be refused. That's all part of the referral and discussion to see whether the registered titles can be amended and more
Amending registered titles can be complex and drawn out for a variety of reasons and as yet matters are unresolved
Until next steps are confirmed/agreed all I can do is try to communicate what's happening at our end.

Thank you for explaining. The message we had been told from our solicitor was that that the amalgamation part of the request had been refused, but sounds like it’s still being considered. We‘ll cross our fingers there’s positive news next week.

Hi Beth - the application is a complex one and I would strongly recommend that you rely on your legal advice here as they are dealing with and managing your own needs and expectations
I am largely just a conduit/messenger for you with regards progress from our end and where any delays might exist. At present that's with my casework colleagues/lawyer as they have to decide next steps inc what can or can't be done,
That may mean further correspondence with the applicant and/or contact with other registered landowners and therefore more delay. But at this stage I can't be definitive as the next steps need to be decided and

I appreciate your comments and we can only hope that the caseworker/lawyers look at the reply and decide the next step ASAP. Is there a timeframe that this should take place in?
As I’ve said we are running out of time to complete this house purchase so anything you can do to try and get it looked at urgently would be greatly appreciated.

We understand that the registered owners of the title plan K254754 have been contacted and have until 30th June to respond re. closing the duplicate title plan. Are you able to confirm if the letter has been sent to the name/address on the title register online? I believe this is Spurdens, 1 Dykes Place.

Hi Beth - that is correct. If they don't respond the case is then reviewed again after the 30th. It's a manual process so it's not an automatic update next day for example but it will be processed asap
